I agree with the junk transmission claim.  My 1996 had a total failure when
the intermediate shaft snapped at 65 m.p.h. cruising on the highway.  It was
two years out of warranty and BMW knocked $500 off the cost of a
replacement.  They don't give away money unless they know there is a
problem.  The indication of a transmission going bad in my case was an
occasional clunk in third gear like the box slipped into neutral and back
into gear by itself.  After spending $1,800 I would never take the risk of
buying a pre 1997 again.  There has been many complaints on this list and
others confirming this same problem.  I only had 33,000 miles and the bike
was dealer maintained.
